How do we account for the gas we use while campaigning when completing our financial reports?

  • The most simple solution would be to determine a mileage rate to use for all campaign related expenses.  Track your mileage while conducting election related business and allocate the appropriate rate. This will account for gas and wear and tear on your vehicle.

When does the Grant of Permission and Acknowledgement & Consent Release of Personal Information form need to be filed by?

  • This form should be filed in the municipal office as soon as possible once you have filed your nomination paper.

​The bank didn't want to accept the "Unofficial List of Candidates" as proof that I was running for election and wouldn't let me open an account?

​Can I put posters on the Community Bulletin Boards?

  • Staff have advised candidates who have asked, that they are able to put posters on the community bulletin boards.  Technically, this is against the current Elections Signage By-Law.  The by-law was created to ensure that "signs" were erected in a controlled manner.  When reviewing the by-law, neither staff nor council members noticed or considered the impact of the definication of "signs" which includes the word "poster" and the consequence of not being able to put posters up on the community bulletin boards.
  • It is staff intention to propose an amendment to the Elections Signage By-law at the September meeting, which will allow the use of community bulletin boards for election posters.  It will be recommended that election posters not be allowed at the Municipal office building as it is also the voting location.
  • Update*** It has been brought to my attention that the General Election Policy and Guidelines contradict the Election Sign By-Law as it relates to the use of the Community Bulletin Boards and Road Allowances.  As the clerk, responsible for overseeing all aspects of a municipal election, and based on the new information it has been decided that moving forward:
  •        Posters are allowed to be posted as per the General Elections Policy and Guidelines; and
  •        Signs are to be erected as per the Elections Sign By-law.

Why do some area businesses receive 208 free garbage tags a year when residents only receive 52?

  • The committee formed to review the Waste Management By-Law back in 2011 and make recommendations to council suggested that 52 free tags per week be provided to each household.  During discussion, the Council of the day approved that recommendation and further amended the draft by-law by providing the extra tags to business owners to help offset the new costs of paying for waste produced over and above the approved free (1 bag per week) limit.  It was an “olive branch” to ease the cost of transition for the owners in suddenly having to pay for garbage disposal.
  • Not all business operators receive those extra tags; this error was that of staff in implementing the program.  Existing campgrounds and two other businesses have received that number of bags since roll out.  Since that time, other business owners have contacted staff who have provided them with an increased number of bags.  Some businesses have not contacted staff and in error were never given the increased number of tags.
  • Additional information may be located in these documents - Committee Recommendations and Report to Council.

Why do campgrounds only pay residential taxes?

  • The Ontario government creates legislation that municipalities and MPAC must comply with in respect to taxation for property purposes.  This legislation states that all types of business whose purpose is mainly to provide accommodation is to be taxed at the same rate as residential properties, even though they are earning money from the sale of that accommodation.  Sections of properties which provide commercial services are taxed at a commercial rate. 
  • In every municipality in Ontario, any property which provides accommodation be it a campground, motel, bed and breakfast etc. is taxed at the same rate as residential properties.  The overall tax bill of the property may be higher based on infrastructure (buildings etc.) but those taxes will be owing no matter if the business was open, closed, earning a profit or completely vacant.  Assessments are based on area, waterfront and infrastructure. 
  • Some HCM homeowners pay as much in taxes as some of our campgrounds simply due to their location, their size and their accessory buildings.
  • In larger centres, hotels/motels are charged business taxes, hotel taxes etc. by the municipalities in which they operate to offset the increased costs of city/town infrastructure including roads, sewage, water, waste, recycling etc.  Until the imposition of bag tags and pay for use waste collection, HCM did not collect any extra payments from businesses for any purpose.
  • Finally, aside from accommodation businesses, simply because a business is in operation on a property does not mean that commercial taxes are levied.  MPAC has rules and policies to follow when classifying properties and regularly reviews physical locations to ensure proper classification is in place.  This is not something that is the responsibility of or is completed by the municipality.

Why do people who have camping trailers on their own otherwise vacant property have to pay a "trailer fee" for months that they use the trailer?

  • As staff understands it, some decades ago, council of the day was lobbied by campground and motel owners who did not feel it was right for people who owned vacant property to use their properties for accommodation, while they paid little to the municipality in the form of taxes due to low assessed values of vacant property. (Even though these motels/campgrounds only paid residential rates.) Their goal was to ensure that council imposed a fee to offset the costs of municipal services of those people who were using our roads and dumps and not paying much in the way of taxes.
  • There was also concern that the businesses were losing income due to people camping on their vacant properties for free.  Council of the day imposed the fees at the request of those business owners.

Can I vote a proxy vote even though I am a candidate?

  • Yes, even though a candidate, you have the same opportunity to vote as anyone.  So long as a proxy form is completed accurately and not signed by the voter prior to being presented to the clerk, the proxy will be valid and you may vote the way the proxy signer has directed you to.
  • You can vote, not only for yourself but for any candidates that the signatory of the proxy has directed you to.  You can only vote for the persons that you have been directed to vote for.

If I have a proxy vote, can my spouse also vote a proxy?

  • Yes, you may vote one proxy vote for a non-relative.  If you are voting for relatives as described in the legislation, you can vote for any number of them.

I have someone who wants to vote for me but is not sure that he can because the property is owned by a group?

  • So long as the group is not a corporation, the individual can vote as he/they are all owners of the property.  If a corporation owns the property, no one can vote unless they are a permanent resident and can vote as a resident.

As a candidate, can I send in an anonymous question to the all candidate's meeting?

  • I don't see why not, you are an elector in HCM as well as any other person and your concerns are just as valid.

I have someone who wants to vote for me but doesn't know if he can because he is a member of a MNRF leased camp?

  • MNRF lessees are entitled to vote.  If they are not already, they must have their name added to the voter's list.  In order to have your name put on the voter's list, you have to provide proof of address/residency/ownership.  With a lease, the individual's name should be on the lease agreement with the MNRF.  There needs to be a paper trail.
  • If a member of an association, which is not incorporated, there must be some type of legal agreement which names all members.  Each of these people are then permitted to apply to have their name added to the voter's list.
  • Members of corporations are not entitled to vote; if the camp ownership is a corporation, there can not be names added to the voter'slist, unless they are permanent residents of the property.
  • Note***I am still researching this response and will add more as it becomes available.

Could you please tell me what the mill rate for garbage is on our taxes.

  • Ontario municipalities no longer calculate their tax rate as a mill rate.
  • The tax rates for Head, Clara & Maria for 2018 are as on the attached by-law.  The amount of money that goes towards waste management including recycling is in the attached budget working document prepared prior to Council passing its budget by-law and adopting tax rates for 2018.   If you so choose, I expect you can determine a mill rate for garbage from this document however; that is not something that the municipality (or any Ontario municipality) calculates or records.  Of a total budget of $1,217,586 (including the Recreation committee and all special purpose grants) waste management costs are budgeted as $66,150 for 2018.  (excluded from that are Waste Management wages and payroll expenses as due to privacy and confidentiality reasons, all wages for each department are combined in one account under Admin.)

  • Alternately, you can go onto the Ministry of Municipal Affairs website and review the FIR or Financial Information Return which displays the costs of services from one year to the next.  You may locate that information here.

We would like to know the following;

How much money does Council put into Rec?  Events, projects, expenses - i.e. wages 

How much of an increase to Liability insurance was needed re the rail bed?

How much grant moneys came in for rec projects (time frame 1-2 years) and how much of Rec's money was used for same?

What is our tax base? How is our tax dollar dispersed; policing, waste management, roads, parks, rec, etc.? Is there a graph or pie chart?

The information you have requested is basically available on the municipal website.  The budgets are created to separate spending into categories – generally.  Special projects are identified as well.  They may be found here - http://www.townshipsofheadclaramaria.ca/departments/administration-finance/  and will be updated shortly to provide for 2016-2018 info.  (This may be found by searching the Agenda and Reports to Council pages for Budget documentation as well.)

When it comes to Recreation – the Rec budget is its own entity except for Parks and Boat Launches. On the working documents for 2018 – all funding for the Recreation Department is earned by the Rec committee.  Council’s only contribution to the $33,300 is the $2,500 committed to Canada Day.

As for staffing – the Recreation position, beginning in 2018 in July will cost Council $15,000 per year.  This position is responsible for recreation as well as general office admin when there is a lull in recreation business including: parks and boat launches, programming, support for the recreation committee, event planning and support, managing the bar and hall rentals, food vendor certificates, water sampling and much more.

Basically for $15,000 per year (beginning in 2019), the community earns approximately the same in profit ($15,000) which over the past 3-4 years has gone into play structures, park improvements, community centre facility improvements, the lending hub etc..  The position pays for itself through rec committee profits which go into the community.  Without this support, volunteers could not host the programming they do.

The increase in insurance has not been completed yet as renewal is later this month.  The cost from $25 mil to $50 mil will only by $1,500 as recommended by our insurer.

The information about grant money is listed separately on the budget working documents.  If you go through them, if not identified in the account name – there will be comments to explain in the definitions column to the far right.

I’m not certain what you mean about what is our tax base?  I have attached the most recent documents provided by the County of Renfrew comparing us with others in the County with respect to taxation – showing what we keep, what the county gets and what we must send to the province.

The first chart shows rates across the county and across all tax classes.  You will see that ours is considerably lower than most. You need to consider the funding from the Federal government for the base in Petawawa and Laurentian Valley which are our closest comparators.

The second spreadsheet shows the amount of money the municipality will earn and keep from taxation for 2018 for all classes.  From residential properties – it is only $129,357. Things would be significantly different without the pipeline.  So when people complain about the amount of taxes they pay…this is what stays in Head, Clara & Maria at .00247867%.  The amount that is forwarded to the County is .00362193% - more than we keep for our own purposes.

We do not have a graph or pie chart but the answer to the question, how much goes to each expense is listed in the Budget – Working Document in detail as well as by Department in the Budget document

This information hasn’t been updated on our website since 2016 but will be completed today.  I have attached 2018’s working document and budget document for review for now.

Is there a document that clearly defines the differences between posters, bulletins, and signs?

No there is not.

Just clarifying some info as I try to collect grant spending re last nights meeting...Account " Recreation Special Projects" and "Rec Expenses" both show $4000 to Canada Day. (From the 2017 Draft Working Document)

Please bear with me as this is Noella’s area of expertise. 

The line from below which is in error is the one beside the “Special Projects” account.  It should be $4,000 less.  You can see beside that notation that there are question marks – I would assume that Noella had to confirm (with me) which account Canada Day was under – made draft notations in both lines and then didn’t remove the incorrect one.  We both missed it.  Canada Day budget is included accurately in Rec Budget total of $27,775.  Council’s $4,000 is there.

Under "Special Projects", the extra $4,000 which was added in error was not recorded as an expense.  Expenses amounted to the other grants listed (see below) – although some funds were not received until 2018.  This is where the auditor comes in and assists with checking year end to ensure that deferred grants are allocated correctly and shown on the books as owing but not yet received.  This is not something that is reflected in the budget but instead in financial statements which are created by the auditor.  He ensures that funds are recorded as expensed and received in the appropriate year.  Often these grants roll over year end making it a little more difficult to see in budget reports - hence the year end financial statements and accounting adjusting entries as verified by our auditor.  Each of these grants will also have final financial reports provided to the grantor which ensure that funds were spent as per their requirements and checked by our auditor.

The other various grants are as follows: $10,884 NHSP (Federal) / $8,000 Seniors Grant (Provincial) / $52,036 Ont. 150-3 OMP Washrooms / $7,700 Ball Diamond - Trillium / $7,250 Playground equip installation /  $4,800 Natural Playscape installation.  All of these other funds have been received and expensed through various programming but not necessarily at these amounts, as some projects come in under and some on budget.  If there are any that are over budget, they are brought to Council’s attention for approval.

Mr Chartrand indicated we had a million dollars in reserves, where does that number show up?

This information was presented to Council  in the Report to Council #20/06/18/1001 prior to adopting the 2018 budget:

"HCM has no debt and has reserves totalling $ 830,990 prior to this budget being passed and $918,990 should council follow staff recommendations. Assuming Council adopts the above resolution, there will be zero surplus forecast for 2018 year end."  

As the budget was adopted as recommended, reserves now total $918,990.

Office Closure on Thursdays - Township office is closed on Thursdays so staff can get caught up.   I'm thinking this would be due to Noella being off, and Crystal needing to work uninterrupted to keep abreast of things. I also am thinking that the Clerk's (Melinda) load would be impacted by the constant need for information and answering complaints so would also need the time to get updated especially for time sensitive items.

We opened up on Thursdays after we opened the new office last year but with Noella off, we are having a hard time keeping caught up while at the same time attempting to learn new processes that neither of us have ever done before.

Winter Access to Mackey Park - I didn't see this one in Q&A so can you tell me what the issue is for this and maybe explain what   happened regarding  snow barrieres being plowedd up after the locals cleared it out themselves.   Why would locals not be allowed to save some taxpayer bucks to do this?

What seems like a simple request, is much more complicated than most people would expect.  The simplest explanation would be trespass on municipal property closed for the season. The reasons behind it are much more involved and are outlined below.  It may seem at first glance that you are “saving some taxpayer bucks” but as usual, there is much more to consider.  Once Council has all the information in front of them, they may make a decision moving forward.

The municipality has a policy which prevents people not employed by or contracted with the municipality from working on municipal property.  This is due in part to legislation such as the Occupational Health and Safety Act, the Occupier’s Liability Act, the Municipal Act and the Negligence Act.  It also involves the potential for damages and liability under the Highway Traffic Act for roads not properly maintained to legislated Minimum Maintenance Standards.

Staff in 2017-2018 were responding to the situation as per existing Council policy.  People are not allowed to work on municipal property AND Jennings Road is only to be plowed to the turnaround at the graveyard.  We did not have the authority to ask our contractor to extend his plowing. We were concerned with the issues as per legislation above. 

People are concerned with staff making decisions not authorized by Council, yet complain when they follow council policy and direction.  We did not have the authority to do anything different.  Charges could have been laid for people working on municipal roads without permission.

In the past, there was considerable discussion about the costs of plowing Jennings Road from Mrs. Condie’s driveway to the graveyard to allow access for Mr. VanderHorn and/or the Boy Scouts.  Ratepayers did not want council spending their money for things that didn’t benefit them.  Staff were in a lose/lose situation, so obtained legal advice and are bringing this situation back to council for direction moving forward as is our job.

If the road was not plowed back in by staff in January, and left accessible, and someone became injured or damaged their vehicle while on municipal property, the municipality would be liable. If the roads were not maintained appropriately, the municipality could be sued and would lose.

In order to correct the situation for the 2018-2019 winter season, staff followed council direction and consulted with the municipal counsel and obtained a legal opinion which I have attached for your information.  This was to be brought to the new Council in December for decision – and will.

Legal Opinion Received but not yet discussed at Council.

While out today, a voter and his proxy asked about the form and which boxes are to be completed in advance of election or advanced poll day. They showed me the form with boxes A-C completed and I noted Box D and Box E not completed. They had taken the form to the Municipal Office and were told to take both pages of the form (carbon copy form) to vote. Are the boxes not to be completed in the presence of you along with your signature etc. prior to voting day and  Box F at time of voting only, or are all 3 to be done at time of voting.

Another issue is that I noted a witness signature in Box 3 of the carbon copy form your office provided and my form of which I printed off the links you have provided does not have a witness signature on the form in Box C. My form is dated 2018/04.

My apologies for this situation.  Front office staff were working with this gentleman on the proxy form last week, and I misunderstood the situation.  I was under the impression that there was only one person in the office, the person appointing a proxy.  I did not realize that the appointee was also there.

Had I realized that, yes, both gentlemen would have signed the forms and I would have kept one copy.  As it is, there is really no problem in that the appointee can simply bring the form with him when he votes, and he can have his form authorized at that time.  There will be a qualified individual there to authorize proxies at both the advance poll and on election day.  My apologies for my error, however; there is an easy fix.

As to the forms, either will be accepted.  The most up to date form does not have a witness signature, the Ministry changes forms routinely.  The older form, which we had a supply of does.  If someone brings a carbon form with or without the witness signature it will be accepted.  From the office, we will use only the newer form from this point forward.

Form 9 – Can they be filled out before voting day?

If you look at the form, it states that the form must be filled out at the voting place.  What I have done however; is provided an individual with a copy of the form – explained to him that it has to be filled out there but he could take a copy with him to review to ensure that he understands what he will be required to do at the voting location on voting day.

All instructions on these forms will be printed right on them; the elections personnel will be trained to follow those instructions and to assist voter’s in whatever capacity is required.

Form EL26 and EL15 are they only available at the polls

EL15 – Application to Amend Voter’s List – Copies are available at the municipal office.  You may also find them on our webpage.

EL 26 – Is a form for election personnel to complete.  It is a list of electors who have been objected to under paragraphs 2 and 3 of subsection 52(1) of the MEA.  It is not normally required.

Any Oath that is required will be provided at the voting place.  Election Personnel will be trained to assist in any way necessary to ensure that a voter has the opportunity to vote.

Have we hired a bylaw officer, if so, who has been hired? Was the job posted on our website or any other media?

We have not hired a by-law enforcement officer.  Bob Labre has provided this service to us to date.  We will begin the process of creating a new position, with a proper job description, training, policies and procedures.  Much work must be completed before we get to this position and with elections and Noella being away, we simply have not had time.

Once a job description and position have been created, staff will follow municipal procedure to advertise for and hire for the position.  This may be some months in happening due to other demands.

Do we have a noise by-law?

Head, Clara & Maria does not have a noise by-law.  We have few by-laws which require active enforcement.  Past councils made a conscious decision to not be too restrictive in this rural, sparsely populated area.  For years it has worked.  With people disrespecting our lack of rules…we will be forced to create more and actively enforce them.  This was one of the findings of the stakeholder consultation meetings earlier this year which resulted in ATV and snowmobile by-laws being created.

Electors are invited to come out and ask questions of the candidates to help with their voting decisions.  Based on the current climate of the community, there is an opportunity to pose anonymous questions, the questions will be vetted to ensure they are appropriate for discussion by an experienced facilitator.  Send any questions to allcandidatesnight@gmail.com, drop them off in the outdoor mail box, or mail them to the municipal office anonimously.  If your question is not asked by someone at the event, it will be asked by the facilitator at the end of the meeting.

August 20, 2018 - Attached please find the Revocation Order IO-2018-05-PEM05-R (revoked 1 p.m. EST on August 20, 2018).  This lifts all travel/Crown land access restrictions under Emergency Area Order 2018-05.

Good afternoon. Great news for campers, cottage owners and those just looking to enjoy a weekend outside. The municipal fire ban has been LIFTED for Head, Clara & Maria.  MNRF warnings and indices have been lowered for our area - dropping to moderate as opposed to high - extreme so we are quite confident in removing fire restrictions.

Please continue to use caution while having campfires. As usual, burn permits are required for any fire larger than one cubic meter. We will re-assess the situation next week, if this is all the rain we get.  Have a great weekend and thank you for your cooperation.

August 14, 2018 - 11:57 a.m.:  

Good morning. We have spoken with staff from Haliburton MNRF. They have advised that even though the rain (and hard work of their crews) have the fires in Maria Township under control, their fire indices show that our area is still at a high to extreme risk for fire.

Weather conditions indicate "a good burn day for today" and the forecasts indicate the potential for lightning with the coming showers on Thursday and Friday.  The indices that the MNRF use to gauge burn conditions are still high to extreme, including the layers under ground which are where lightning fires normally originate.

They have few crews available to address new starts, which are expected with the coming weather, which include lightning.  For these reasons, the FIRE BAN in HEAD, CLARA & MARIA is STILL IN EFFECT until further notice.

We thank you for your patience, understanding and cooperation in keeping our community safe.

We will advise when the ban is lifted.

August 13, 2018 - 10:35 a.m.:The implementation order issued by the MNRF on August 7th, 2018 has been revoked and replaced with the following:
All use of Crown lands located within the fire perimeters in the Geographic Township of Maria (Pembroke District), as outlined on the attached Implementation Order map within the EAO, is restricted.
Note: Travel and use of Bissett Creek Road is now permitted, however, fire crews are still working in the area so travelers are asked to take extra caution when driving near or through the burn area.
This order is in effect as of 9 p.m. EST on August 12, 2018 and will remain in place until such time as the order is revoked.

August 10, 2018 - 11:46 a.m.: Bissett Creek waste disposal site is returning to normal hours of operation, and will be open tomorrow from 12:45 - 3:45 pm. Stonecliffe was disposal site is open from 8:30 am- 12:00 pm.

August 8, 2018- 9:31 a.m.: The implementation order that was issued on July 22nd, 2018 has been revoked by the MNRF. A new implementation order was issued August 7th which restricts all travel and use of Crown lands located within the fire burn areas in Maria Township. Travel and use of Bissett Creek Road between Menet Lake Road and the Algonquin Park boundary and Crown land on or within 500 metres of the road is not permitted between the hours of 7:00 a.m. and 7:00 p.m. unless authorized by a travel permit issued by the Pembroke District of the MNRF. Beyond these hours, use of the modified travel area is permitted. This order is in effect until further notice.

August 2, 2018 - 2:50 p.m.:MNRF crews continue to make good progress on all fires. Pembroke 5 and 7 are under control while Pembroke 6 and Algonquin Park 11 are being held! Travel restrictions are still in place, with an unknown date of revocation. The MNRF will only revoke the travel restrictions when it is safe to do so, and will notify us when that occurs. All crown access road in Maria Township are restricted, as well as Menet Lake Road, Deux Rivieres Creek Road and Deermeadow Lake Road. Updates will be provided as they become available.

July 31, 2018 - 2:20 p.m.:There have been questions regarding the smell and visibility of smoke in the townships and we want to confirm that there are no new fires. Pem 005 and 007 are being held, and are not expected to grow given current conditions and resources allocated to them. Pem 006 is still classified as not under control, however, MNRF has reported no size increase and crews are making good progress with this fire. Because the wind is blowing SW, the excess smoke we are seeing and smelling could be from the Parry Sound fires. The MNRF was unable to indicate when travel restrictions will be lifted, but will notify us when it is safe to do so.

July 30, 2018 - 9:51 a.m.: On July 29, 2018 the MNRF reported on their website:
Pembroke 5 is 37.5 hectares and Pembroke 7 is 72.5 hectares. Both fires are being held. Crews are working the interior of the fires looking for hot spots and expanding the control line around the fire.
Pembroke 6 is not yet under control. No growth was observed today on this fire. Crews continue to make progress on the perimeter of the fire while they identify and suppress hot spots.

July 27, 2018 - 10:17 a.m.:  From the MNRF Website at close of day Thursday... Pembroke 5, 6, and 7 - "Fire activity on the Pembroke fires was minimal again today. Pembroke 5, south of Grant’s Creek, is 37.5 hectares in size and has shown no growth. Pembroke 6 has twenty-four firefighters assigned and covers 697 hectares. Pembroke 7 which runs parallel to Highway 17 is now being held at 72.5 hectares.  Values protection continues."

The County wide Restricted Fire Zone continues. The Municipal Fire Ban continues. Travel continues to be restricted in Maria township including Menet Lake Road and Deux Rivieres Creek Road and DeerMeadow Lake Road.  Please plan your weekend activities accordingly.

July 26, 2018 - 7:01 p.m.:  Good evening. Contrary to reports by members of the public, the fires in Head, Clara & Maria are still active with two still being listed as NOT under control. We have had reports of people saying that the fires are out. This is far from the truth. Even with rain, the fires are still fully engaged and the fire risk remains high. The MNRF Restricted Fire Zone over the entire Municipality and the Travel Ban within Maria Township continue until further notice.

As of 6:56 p.m. this evening. MNRF has reported that Pem 007 - the fire closest to the highway and Grants' Creek in Bissett Creek is now 72.5 hectares and is now listed as "Being Held".  Pem 005 is 37.5 hectares and is still NOT under control.  Pem 006 the fire closest to Algonquin Park is 697 hectares and is still NOT under control.  Please respect the MNRF experts and their reports and the Municipal Fire Ban.

July 26, 2018 - 10:28 a.m.:  Residents in Mackey have been concerned about the smell of smoke in the air this morning.  Prevailing winds are carrying smoke from area fires further than usual.  There have been no new fires reported in the municipality.  Should you observe an as yet unidentified fire, please call the MNRF immediately at 310 FIRE or 310 3473 and later notify the municipal office staff at 613-586-2526 so we can keep everyone updated.

July 26, 2018 - 10:25 a.m.:  Morning Updates from the Provincial Emergency Operations Centre...  "There are currently 132 active wildland fires in the province in various stages of control. There has been no change in evacuation recommendations over the last 24 hours, however, the PEOC is closely monitoring large fires with the potential to affect additional communities (municipalities and First Nations)."

From the MNRF...  "Continued fire suppression and value protection efforts. ... 4 MNRF Emergency Area Orders continue in the following areas: Kenora, Parry Sound, Pembroke - PEM 007 (2018-22), North Bay... For more information on travel restrictions and fire conditions visit: www.ontario.ca/page/forest-fires" link.

Future Outlook: " MNRF advises that the fire hazard for the province is moderate to extreme. There is no significant fire growth expected over the next 24 to 48 hours, however, the fire risk across Ontario is expected to continue for the next several weeks. Precipitation over the last 24 hours has allowed ground crews to make progress on existing fires, and rainfall over the next couple of days will continue to be scattered within the NE Region. Drier conditions are expected this weekend and fire indices are expected to increase at that time. Priority setting continues as some fires are brought under control and others continue to grow."

Please Note******The Ministry of Natural Resources and Forestry Restricted Fire Zone continues in Head, Clara & Maria. The Municipal Fire ban is still in effect. Travel restrictions for Maria Township are still in effect.

July 25, 2018 - 5:34 p.m.:  From the MNRF Website - Restricted fire zones - Effective July 23, 2018  Restricted fire zone expanded to additional parts of the Northeast fire region (southern region)  Due to the extreme fire hazard, several recent periods of heavy lightning, little precipitation and increased forest fire, the Ministry of Natural Resources and Forestry has expanded the Restricted Fire Zone to include parts of the Southern Region of Ontario as outlined on the interactive map.  This expansion of the current Restricted Fire Zone will be in effect as of 12:01 AM on July 24th, and remain in place until further notice.  

  • The expanded Restricted Fire Zone now includes Zones 24, 25, & 26 which would include areas south of the French River, including Parry Sound, from Georgian Bay east to the Quebec border, including Algonquin Provincial Park and from Renfrew north to Mattawa.
  • To date, the current MNRF Restricted Fire Zone covers Zones 16, 17, 18, 19, 20, 21, 24, 25, & 26 and restrictions will remain in place until further notice.  See the fire map for an outline of the zones covered.
  • During a Restricted Fire Zone, the use of open fires – such as campfires, or burning of brush or debris, is restricted. Failure to comply could result in fines of up to $25,000 and three months in jail, as well as financial responsibility for the costs incurred in fighting a forest fire.
  • Portable gas or propane stoves are permitted for use for cooking or warmth, though they should be closely monitored. Portable charcoal BBQs and Hibachis are not permitted unless within 100 metres of a dwelling, or within an organized campground.
  • Commercial campground operators may allow their guests to enjoy campfires during a Restricted Fire Zone period provided they meet certain conditions in the Outdoor Fires Regulation (207/96) .

The Restricted Fire Zone is a temporary measure to reduce the number of new human-caused wildfires as the Aviation Forest Fire and Emergency Services branch of the OMNRF expects the elevated forest fire hazard to continue into the foreseeable future.

July 25, 2018 - 5:31 p.m.:  The following from the MNRF website... Pembroke 5, 6, and 7 - No aerial fire suppression was required on these fires today.  Pembroke 5, south of Grant’s Creek, is 37.5 hectares in size. Pembroke 6 and is burning at 697 hectares. Pembroke 7 runs parallel to Highway 17 and was remapped to 45 hectares. The status of these fires is still not under control.  Values protection continues.

July 25, 2018 - 5:23 p.m.:  We have received an update from the MNRF and would like to reiterate that the fire ban in Head, Clara & Maria is still in effect until further notice.  The fires are still active and considered NOT under control despite the rain we have received. Fires are active living entities and can change quickly. Despite the rain, as soon as the sun and wind returns, fires often rise up again.  Rain recorded in one part of the community is only representative of that one location - some other areas have received very little rain over the past couple of days, especially those areas furthest from the Ottawa River. The Emergency Implementation Order is still in effect and will be for some time, restricting travel to all areas of Maria Township and some roads in Head and Clara townships south of Highway 17.  We will post changes as they become available. Please check back here for information received and confirmed through appropriate channels.

July 25, 2018 - 4:03 p.m.:  The following is a message the Pembroke MNRF is sharing with its Land Use Permit holders...“As of the morning of July 25th, there has been no loss of structures in the areas of forest fires Pembroke 5, 6 or 7. We are continuing to provide values protection (in the form of sprinkler systems) as a precaution to structures near the affected areas. We will continue to assess the need for new values protection measures as the fire situation develops.”  We have contacted the Ministry and have not received an update specific to our area. Rainfall, especially with thunderstorms, does not necessarily reduce the fire risk immediately. Rainfall received in one location does not guarantee that it has been equally distributed over the area.  Please be advised that until further notice, the Municipal Fire Ban is still in effect.

July 24, 2018 - 2:29 p.m.: The MNRF has informed us that their crews have had a chance to re-size the active fires in our area. Pem006, burning closest to Algonquin Park's border, is covering 697 hectares. Pem007, burning closest to Highway 17, is 45 hectares. Pem005, south of Grant's Creek is still showing as 37.5 hectares but may be updated in the future. This does not mean that the fires have reduced in size; the previously reported sizes were based on estimates gathered from the air, which can be difficult to obtain. All three fires are currently NOT under control. MNRF has notified us that the fires in our area are being managed by an Incident Management Team and to date there are no lost values. Their value protection efforts have been successful and they will continue to protect property that is in close proximity to fires.

July 24, 2018 - 12:02 p.m.: We would just like to clarify some misinformation which was being shared on Facebook over the weekend. Apparently there was rumour of evacuations in Mackey and Stonecliffe. Please be advised that the forest fires are not anywhere near Mackey. They are quite some distance from Stonecliffe and are even a significant distance from residences in Bissett Creek. Deux Rivieres is not in any danger as well. Concern is with camps in the geographic township of Maria and all access to interior forest access roads is being blocked.If there were ever a need for evacuation - it would certainly occur in cooperation with the municipality. Up dated information would be shared via municipal and Ministry of Natural Resources and Forestry sources and not second hand. Also, we do realize that a number of our residents do not have access to or use social media. Rest assured that if there were evacuation orders, all residents would be made aware and would not need to rely on Facebook messages to get official notice. To repeat - there is no danger to residents of Head, Clara & Maria in any of the hamlets of Mackey, Stonecliffe, Bissett Creek or Deux Rivieres at this time. Should that change, residents will be notified.

July 24, 2018 - 10:16 a.m.:"All travel and use of Crown lands located in the Geographic Township of Maria (Pembroke District) is restricted. All travel and use of Menet Lake Road, Deux Rivieres Creek Road and Deermeadow Lake Road. All use and occupation of Crown land on or within 500 metres of the described closed roads is also prohibited. If a member of the public believes that access within the restricted travel area is necessary for non-recreational purposes, please call 613-732-3661 to request a travel authorization permit. MNRF will review the request for access based on the rationale provided, local fire activity, and the potential fire risk.See the restricted travel and access areas on this PDF map (Note: this map gets updated regularly)."

July 24, 2018 - 9:46 a.m.: Due to travel restrictions in Maria Township, the Bissett Creek disposal site will remain closed until further notice. The Kenny Road Landfill in Mackey will be open Tuesdays from 1:00 - 3:30 p.m., Thursdays from 12:45 - 4:15 p.m. and Saturdays from 8:30 a.m. -12:00 p.m. and 12:45 - 3:45 p.m. Please contact the municipal office if you have any questions or concerns at 613-586-2526.

July 23, 2018 - 8:54 p.m.: We are experiencing light rain in some parts of the municipality. MNRF staff are physically blocking access to the forest acess roads in Maria township, south of the highway, as well as access roads to Maria from the east and west forest access roads. If you have travel plans for camps, including Algonquin Park in this area, you may be denied access to crown land.Please be prepared to change your plans as this is a fluid situation.We will post new information as it becomes available.

July 23, 2018- 8:48 p.m.: The pics below are from the MNRF website and show the area the active fires are in...Pem 007 - the fire closest to the highway is now 90 hectares...Pem 005 closest to Grant's Creek and Owl Lake is 37.5 h....and Pem 006 closest to Christopher Robin and Big Bissett Lake shows 400 h although we have been told by the MNRF it is larger at near 800 h. It does take time for data to be uploaded. Especially with so many active fires in Ontario right now.

July 23,  2018 - 10:20 a.m.:We have received some questions regarding the Implementation Order issued by the MNRF. The restrictions are for all crown land access roads in Maria Township as well as Deux Rivieres Creek Road, Menet Lake Road and Deermeadow Lake Road. Please see the map provided. This Implementation Order does not impact Highway 17. The OPP may close the highway at their discretion to ensure health and safety. The 511 website shows an updated list of highway closures and is available at https://511on.ca.

July 22, 2018 - 2:37 p.m.: Forest Fire Update in Head, Clara and Maria Townships:

The two fires closest to Algonquin Park’s border in Maria Township have merged (Pembroke 6 & 8) and are now burning at an estimated 800 hectares. Fire crews are on scene assessing the situation and how to best proceed with the resources available.
The fire running parallel to Highway 17 (Pembroke 7) is covering approximately 40 hectares while the third fire (Pembroke 5), south of Grant’s Creek, is 24 hectares. Officials from MNRF have confirmed the numbers for these two fires do not include growth, and that none of the fires are currently under control. Fire size, locations and status can be viewed online at https://Ontario.ca/forestfire.
The Ontario Provincial Police have closed and re-opened Highway 17 several times over the weekend and may continue to do at their discretion to ensure health and safety. The 511 website shows an updated list of highway closures and is available at https://511on.ca.
MNRF have stated that they are protecting values and camps that may be in close proximity to the fires by way of sprinkler systems.
There has been some false information circulating on social media in regards to evacuation orders, and at this time The Townships of Head, Clara and Maria, working closely with the MNRF, are not concerned with evacuations. If evacuations are to occur, it will be posted on our municipal website, official Facebook page, and through community email. We have an emergency plan and volunteers who are responsible for certain sections of each hamlet; to ensure residents are evacuated safely if required. The MNRF will not issue evacuation orders to residents, but will provide the municipality with recommendations of evacuation if they deem it necessary.
The MNRF has issued an implementation order to restrict access of all travel and use of crown lands in Maria Township as well as Menet Lake Road, Deux Rivieres Creek Road and Deermeadow Lake Road. Unless authorized by a travel permit issued by the Pembroke District of the MNRF, this Order restricts travel, access and use of the above listed areas, and may be modified regularly to reflect changing fire conditions. This measure is put in place to protect the public and ensure public safety while allowing fire personnel to safely fight forest fires in the identified area.

Thank you for your cooperation at this time, and updates will be provided as they become available.

July 21, 2018 - 3:59 p.m.: We are still working closely with the MNRF to monitor active fires in our area, and are not concerned with evacuation at this time. We will continue to provide updates as they are available.

July 20, 2018 -2:33 p.m.: Please be advised that there are currently four active fires in Maria Township that the Ministry of Natural Resources and Forestry are working on. If you are on the water, please stay clear of water bombers so they can do their jobs properly. Smoke from the fires is causing reduced visibility along some parts of Highway 17, so please be cautious when driving. We are working closely with the MNRF to ensure resident health and safety, and are not concerned with evacuation at this time. Thank you for your cooperation.

The Challenge unites communities with a common goal of promoting children’s health through healthy eating and physical activity. Physical Activity Equipment Lending Hubs were created with the mission of eliminating barriers to physical activity, increasing availability and access to physical activity opportunities for everyone, providing opportunities to try new physical activities and improving flexibility of equipment pick up and drop off.

The United Townships of Head, Clara and Maria was successful in obtaining funding through the Healthy Kids Community Challenge to purchase:

Kayaks

Bicycles

Volley Ball/ Badminton Set

Hockey Nets

Helmets

Life Jackets

A variety of balls and smaller sports equipment

All of this equipment is available to borrow at no cost, for up to a week at a time. Reservations can be made by calling the office at 613-586-2526 or emailing hcminfocfischer@gmail.com; book in advance to avoid disappointment. A waiver must be signed, and ID provided.

A big thank you to all those working on the Healthy Kids Community Challenge. Our Lending Hub has received wonderful feedback, is used regularly and has surpassed our expectations. A thank you to HCM Rec Committee who has purchased additional equipment for the Lending Hub as a result of increasing equipment demands.

VOTER IDENTIFICATION

This is the English version of a bilingual regulation.

Proof of identity and residence

1. The following is prescribed as the proof of identity and residence that a person may present for the purposes of paragraph 1 of subsection 52 (1) of the Act:

1. An original, or a certified or notarial copy, of a document that is listed in Schedule 1 and shows the person’s name and qualifying address. O. Reg. 304/13, s. 1; O. Reg. 151/18, s. 1.

Form for application and statutory declaration

2. The following is prescribed as the form that a person may complete for the purposes of paragraph 1 of subsection 52 (1) of the Act:

1. Form 9, entitled “Declaration of Identity” (application and statutory declaration under paragraph 1 of subsection 52 (1) of the Act), dated April, 2018 and available on the website of the Government of Ontario Central Forms Repository under the listing for the Ministry of Municipal Affairs. O. Reg. 304/13, s. 2; O. Reg. 151/18, s. 1, 2.

SCHEDULE 1

1. An Ontario driver’s licence.

2. An Ontario Health Card (photo card).

3. An Ontario Photo Card.

4. An Ontario motor vehicle permit (vehicle portion).

5. A cancelled personalized cheque.

6. A mortgage statement, lease or rental agreement relating to property in Ontario.

7. An insurance policy or insurance statement.

8. A loan agreement or other financial agreement with a financial institution.

9. A document issued or certified by a court in Ontario.

10. Any other document from the government of Canada, Ontario or a municipality in Ontario or from an agency of such a government.

11. Any document from a Band Council in Ontario established under the Indian Act (Canada).

12. An income tax assessment notice.

13. A Child Tax Benefit Statement.

14. A Statement of Employment Insurance Benefits Paid T4E.

15. A Statement of Old Age Security T4A (OAS).

16. A Statement of Canada Pension Plan Benefits T4A (P).

17. A Canada Pension Plan Statement of Contributions.

18. A Statement of Direct Deposit for Ontario Works.

19. A Statement of Direct Deposit for Ontario Disability Support Program.

20. A Workplace Safety and Insurance Board Statement of Benefits T5007.

21. A property tax assessment.

22. A credit card statement, bank account statement, or RRSP, RRIF, RHOSP or T5 statement.

23. A CNIB Card or a card from another registered charitable organization that provides services to persons with disabilities.

25. A document showing campus residence, issued by the office or officials responsible for student residence at a post-secondary institution.

26. A document showing residence at a long-term care home under the Long-Term Care Homes Act, 2007, issued by the Administrator for the home.

27. A utility bill for hydro, water, gas, telephone or cable TV or a bill from a public utilities commission.

28. A cheque stub, T4 statement or pay receipt issued by an employer.

29. A transcript or report card from a post-secondary school.

Revisions to the voter’s list may be made by attending at the Clerk’s office in the Municipal Office Building in Stonecliffe any business day (Monday to Wednesday and Friday) from 8:30 a.m. to 4:00 p.m. up to and including Monday, October 22, 2018 (up to 8:00 pm on the 22nd). Please note that the Municipal Office is closed Thursdays until further notice.

  • The voter's list will not be left on the front counter - the Clerk or designate will look up the information and will confirm personal information with the voter.
  • Lists shall not be posted in public places but will be made available with supervised access as described above.
  • Information about a person' spouse, children or neighbours is confidential and will not be divulged;  a person is legally entitled to see only their own personal information.
  • Applications for revisions to the voter's list will only be accepted on fully completed " Applications to Amend Voter's List" Forms available on-line or at the Clerk's office.
  • Identification required to make any change consists of provincially or federally issued photo ID or 3 pieces of non-photo ID identifying your name, address and signature.

Qualifications of electors

17 (1) Repealed:  2002, c. 17, Sched. D, s. 5 (1).

Qualifications

(2) A person is entitled to be an elector at an election held in a local municipality if, on voting day, he or she,

(a) resides in the local municipality or is the owner or tenant of land there, or the spouse of such owner or tenant;

(b) is a Canadian citizen;

(c) is at least 18 years old; and

(d) is not prohibited from voting under subsection (3) or otherwise by law. 2002, c. 17, Sched. D, s. 5 (2); 2005, c. 5, s. 46 (1).

Persons prohibited from voting

(3) The following are prohibited from voting:

1. A person who is serving a sentence of imprisonment in a penal or correctional institution.

2. A corporation.

3. A person acting as executor or trustee or in any other representative capacity, except as a voting proxy in accordance with section 44.

4. A person who was convicted of the corrupt practice described in subsection 90 (3), if voting day in the current election is less than five years after voting day in the election in respect of which he or she was convicted. 1996, c. 32, Sched., s. 17 (3); 2006, c. 9, Sched. H, s. 4.

Status as tenant

(4) Despite the definitions of “owner or tenant” and “tenant” in subsection 1 (1), a regulation may specify circumstances in which a person is, and is not, considered to be a tenant for the purposes of clause (2) (a). 2016, c. 15, s. 13.

By partnering with various federal and provincial ministries and special funding organizations, we have worked to leverage existing funds through grant opportunities.

Thank you to the Federal Government through its Canada 150 Community Infrastructure Fund for support for improvements to Old Mackey Park through new washrooms, solar lighting, pathways and waste receptacles.  Without funding such as through these programs, projects such as ours would not be possible.

Throughout this process we have managed to participate in some awesome Canada and Ontario 150 projects which have resulted in improvements to our three boat launches - in Deux Rivieres, Stonecliffe and Mackey.  We have also made changes to our facilities at Old Mackey Park at the end of Jennings Road in Mackey.  The Recreation Committee has plans to make further improvements to Lacroix Park in Deux Rivieres.

Children's areas have been installed at the Municipal property in Stonecliffe and at Old Mackey Park.

Washrooms, lighting and pathways have been improved at Old Mackey Park.

Boat launches have seen improved washrooms, lighting and waste containers; along with new docks to aid in launching boats to enjoy the Ottawa River.

Thank you to those who have contributed to the fundraising activities which have occured over the past years.

A special thank you also to the various government organizations which have supported our activities.

OUR NATURAL PLAYGROUND - ALONG THE OTTAWA RIVER

Since 2016, Head, Clara & Maria has been able to provide upgrades to our municipal boat launches and Old Mackey Park with support from the Government of Canada through the Canada 150 Community Infrastructure Program.  Upgrades include: upgraded washroom facilities, new docks, solar lighting, permanent garbage and recycling bear proof containers, permanent picnic tables, hand wash stations and pest control. 

Improvements have been made at each boat launch in Deux Rivieres, Stonecliffe and Mackey, as well as our municipal park on Jennings Road in Mackey. Our goals were increased health and safety of users while increasing use of our outdoor facilities. We hope you enjoy the improvements to our boat launch and park facilities as you enjoy our natural playground.

  • Special Needs Items (infant formula, spare glasses)
     
  • Candles & matches or lighter and fluid
     
  • Backpack/duffel bag or other type of carrying case (in case you have to evacuate)
     
  • Extra car keys and cash (bank machines and credit cards will not work if the power is out)
     
  • Whistle (to attract attention)
     
  • Identification Documents (copies of identification - birth certificates/passports/licenses)
     
  • Playing cards, games (you will need a diversion especially if you have children around)

In 2016 Head, Clara & Maria staff was successful in obtaining funding through Canada 150 Program through Heritage Canada.  We are pleased to acknowledge receipt of funds from the federal government for improvements to the municipal boat launches at Mackey, Stonecliffe and Deux Rivieres.  Funding has allowed us to install solar motion activated lights, dock extensions with reflectors, permanent waste and recycling receptacles and still to come, new picnic tables.  Council heard your request for improved facilities.  With assistance from the federal government, they came to fruition.  Thank you.

In 2011 funding was received from the Federal and Provincial governments through "Canada's Economic Action Plan" and "Ontario's Creating Jobs. Building Ontario." infrastructure programs to update the municipal hall/office/library and garage.

Funding was received from Human Resource and Development Canada through the "Enabling Accessibilty Fund" to update the outdated and inaccessible washroom facilities within the Community Hall.

The Federal Gas Tax funds were used to meet the requirements of Ontario's new drinking water legislation and update the water facilities at the Municipal hall including a new well, and filtering systems.

The Ontario Trillium Foundation approved funding in excess of $30,000 to install a pavillion and play equipment at Old Mackey Park making this a comfortable gathering place for young and old alike.

Thank you to the various individuals who worked on, approved and implemented these programs so that our residents could benefit. Through various grant and fundraising efforts we hope to continue with our record of success.

Fundraising Opportunities

The Recreation Committee formed in 2014 have been holding various functions at the Municipal Community Centre to raise funds for Council and Rec Committee objectives.  Some of these listed for 2014-2015 include: a bench and tree beside the Veteran's Memorial in Stonecliffe, benches, shade trees and a slide at Old Mackey Park, and washroom facilities at Stonecliffe Boat Launch.  

Donations

Council has approved a donation campaign which was kicked off with a letter included in the 2011 first installment tax bills. Council donation priorities for 2011 include: updates to Old Mackey Park including picnic tables, benches, landscaping; updates to LaCroix Park including picnic tables and/or benches; refinishing the hall floor by leveling and applying the same flooring as used in the washroom renovation; minimal contributions to Canada Day Celebrations.

To make a contribution, simply forward a cheque made payable to the United Townships of Head, Clara & Maria indicating that the funds are to be directed to our donations program. If you would like your contribution to be anonymous, please indicate this on your contribution or otherwise contact us; otherwise recognition will be given in various ways including notation on this website. If you would like to see your contribution directed a specific way, to meet 2011's priorities, please also indicate that. If there is no direction the funds will be co-mingled and used to meet Council's priorities as staff sees fit.

<![CDATA[Recycling in Head, Clara & Maria]]>http://www.townshipsofheadclaramaria.ca/departments/recycling/http://www.townshipsofheadclaramaria.ca/departments/recycling/Fri, 13 Jan 2017 11:00:36 -0500Thank you for your interest in our Municipal Recycling Program.  In February of 2007, our municipality contracted with a small firm to collect recyclables; in 2016 the municipality assumed responsiblity for collection contracting with Beauman to collect from bins at the municipal disposal sites.  All materials should be cleaned and placed in clear (transparent) plastic bags for collection.  This prevents materials from absorbing water from rain or snow and making them more difficult to collect and process.

There are a few simple rules to ensure that the materials collected end up recycled and not in our landfill.  All containers and material must be clean.  Containers must be rinsed so that no food particles remain in or on the container or bag.  It is not necessary to remove outside paper from cans however; it is advisable to push the lids down inside the cans to prevent injuries during handling.  Please separate paper products from those that have been washed to prevent damage and contamination.  Unclean and damaged (wet) material will end up in our landfill.  Please do your part to keep our Township green.

Cottagers - please make your best efforts to join in our program.  Depending on where you live, you may be able to place your recyclables out along with full time residents at designated locations.  Alternately, you may bring them to the Stonecliffe and Bissett Creek Disposal Sites.  For more information call the Township Office at 613-586-2526 or email hcminfocfischer@gmail.com.

Local Business Operators - Bins located at both Waste Disposal Sites are available for large volumes of recyclable materials.  All material must be prepared as for household collection i.e. cleaned and bagged (aside from cardboard boxes which may be tied in manageable bundles).

Fire Service in the Municipality
Council, at its meeting of Friday, March 7, 2008, considered the options available to the municipality in respect to fire suppression services and entered into a 5-year agreement with the Ministry of Natural Resources.  The Agreement has been signed. 

Council has passed by-law 2008-15 rescinding the by-laws that created the fire service.  The Fire Ban by-law and by-law to Regulate Open Air Burning are still valid and will be amended by by-law 2008-15. At its meeting of Friday, May 2, 2008 Council also voted, by resolution, to declare the fire equipment surplus and sell it to the highest bidder at a public sale.    Posted - June 11, 2008

Smoke Alarms Exchange Program*

Head, Clara & Maria Township residents and ratepayers are eligible to receive a new SMOKE ALARM free of charge in exchange for one that is more than 5 years old. Please contact the municipal office.  We also have carbon monoxide detectors for sale at a reduced rate.  $33.35.

IN CASE OF FIRE -During fire season (April 1 to October 31), please call the MNRF at 310 FIRE (3473). Outside fire season, call the OPP if the smoke is blowing onto a municipal road or highway, for traffic control;and the Renfrew County Paramedics if lives are in danger.

The County of Renfrew performs planning functions for HCM.  The fees are determined by the County of Renfrew and may be learned by contacting them.

Fees for Zoning By-law or Official Plan Amendments will include the County Fee plus $200 payable to the Municipality to cover costs.  Overpayments will be reimbursed at the end of the process.  Underpayments will be invoiced.

This program is operated by a non-profit as a public service and attempts to collect hazardous materials and divert them from our landfill. 

There is no cost to the user or the municipality.  Please do your part to use this service to keep these materials out of our landfill and ultimately our groundwater. 

The office is open Monday- Wednesday and Friday, 8:30 am - 4:00 pm.

Deux Rivieres site closed effective September 30, 2007 

Due to MOE regulations, our site attendant will only accept from Municipal residents, materials that have been generated within our municipality.  It is not lawful to accept material from outside our municipality nor is it legal for our residents to remove waste generated in Head, Clara & Maria to other municipalities.

Head, Clara & Maria does not have it's own Official Plan. This means that we have adopted the County of Renfrew's Official Plan and are governed by it. A copy of the County Official Plan is available in the municipal office for your review.

Zoning By-Law

Although we do have a zoning by-law it does not specifically zone areas as commercial, residential or any other use. We use a system whereby all property is zoned according to use. You will find a composite copy of our Comprehensive Zoning By-law here or at the Township Office which incorporates the amendments made by By-Law #2011-17 (passed July 15, 2011) relating to home based businesses and occupations.

Zoning By-law Amendments

Any person may attend any public meeting held to consider zoning by-law amendments and is encouraged to make written or verbal representation either in support of or in opposition to the amendment. If a person or public body does not make oral submissions at a public meeting or make written submissions to the Township of Head, Clara & Maria before the by-law is passed, the person or public body is not entitled to appeal the decision of the Council of the Township of Head, Clara & Maria, to the Ontario Municipal Board.

If a person or public body does not make oral submissions at a public meeting, or make written submissions to the Township of Head, Clara & Maria before the by-law is passed, the person or public body may not be added as a party to the hearing of an appeal before the Ontario Municipal Board unless, in the opinion of the Board, there are reasonable grounds to do so. We wanted to pass on information that we have received. Shipping or cargo containers have been determined to be structures for assessment purposes. MPAC has decided that these containers will be assessed. Depending on the use of your container, a building permit may be necessary. Remember, no matter what type of structure - zoning conditions such as set backs have to be addressed. Please consider these issues when placing structures or containers on your property. Building

Our Chief Building Official (CBO)

Our Chief Building Official is Robert (Bob) Labre. He can be reached at 613-586-1950. Due to volume of building activity, Bob only works one day a week for us and office hours will fluctuate due to field work and inspections. Please leave a message on his answering service - he will get back to you and arrange for appointments and/or inspections as necessary.

Council has adopted the following CBO Code of Conduct.

Lot Requirements

No Person shall use any lot or erect, alter or use any building or structure within the United Townships of Head, Clara & Maria except in accordance with the following provisions:

Lot Area (minimum): 2025 square metres
Lot Frontage (minimum):  30 metres
Front Yard Depth  (minimum):  7.5 metres
Side Yard Width  (minimum):  3 metres
Rear Yard Depth (minimum):  3 metres
Dwelling Unit Area (minimum):  55 square metres
Cottage Unit Area (minimum):  29 square metres
Lot Coverage (minimum): 35%
Building Height (maximum): 10.5 metres
Water Setback: 15 metres from the high water mark

Snow on Roads

The Township is responsible for maintaining 18 km of rural gravel roads.  Each year the Council of the Municipality of the United Townships of Head, Clara & Maria requests the cooperation of all persons in keeping vehicles from obstructing snow removal operations in the Municipality and in refraining from placing snow from private property onto Municipal roadways. Notification is placed in the local newspaper in October or November. Necessary action will be taken against persons contravening the Highway Traffic Act in this respect.

 Winter conditions are regularly monitored in all areas of the United Townships of Head, Clara & Maria.  As winter approaches, a supply of sand/salt mixture is contracted for, our plowing contract is initiated and roads personnel prepare for the first snowfall. 

Snowplowing

Snowplow operations begin with the first significant snowfall.  This can be as early as November 15 or as late as December.  Township bylaws prohibit parking or stopping on the road in a way that interferes with plowing operations.  Plow operators need clear roadways to complete their routes safely and on time.  Under the Highway Traffic Act, residents are not allowed to deposit snow on the roadway.  When clearing snow, pile it on your property – do not shovel it onto the road or across the road into the ditch.  This practice is dangerous because it may cover the salt/sand applied and may cause drivers to lose control.  It may also cause windrows of snow that freeze across the road causing further hazards.

Sanding

The sand applied to roads is mixed with a certain percentage of salt to prevent the sand from freezing.  During freezing rain or other icy conditions this mixture may be increased to provide safer driving conditions.  The Township does not apply unmixed salt to roads.  Sanding is normally completed on hills, curves, intersections and railway crossings but may be applied to other areas if icy conditions occur.

Which streets are the first to be plowed?

Council has created policy that outlines the parameters for route determination.  The routes are designed to clear roads in a systematic way that generally gives priority to efficiency and safety. 

 Why does it sometimes take a long time for my road to be plowed?

During normal snowfall events, the plow driver will strive to follow his route in the same way every time.  This will provide some consistency in the timeframe that the plow completes each road.  Some winter events are much more severe than others, leading to exceptionally large quantities of snowfall, drifting, or freezing rain.  In these conditions, the plow may have to take longer to complete the first roads. 
When available, two trucks will be on the roads decreasing the time for all roads to be cleared.  Generally, when this occurs, one begins at the easternmost end of the municipality and the other goes to the west.  This is not contracted but an extra service provided by our contractor.  During periods of freezing rain, the plow may have to apply much more sand than normal, requiring the truck to travel off route more often for refilling. 

How long does snow clearance usually take?

Based on the Class 5 and Class 6 roads that comprise our municipal roads, the Minimum Service Level is to complete clearing roads within 24 hours of the end of the event.  Most routes however are completed within an 8-10 hour period of the plows being called out at the three (3) inch depth mark.  This time may be extended during exceptionally heavy snowfall or freezing rain events.  In accordance with Ministry of Labour regulations, drivers cannot work for more than 13 hours without an extended rest period.  There are other restrictions limiting the number of consecutive days a driver can work.  These regulations were put in place to protect our drivers and other motorists.  Depending of the event, this may affect the service that we receive.

What happens during a normal snowfall event?

Early in the morning, when winter events are being forecast, the Road Superintendent monitors the weather conditions of Township roads.  If a winter storm develops the Super will call in the contractor for a normal 6 a.m. start and will begin plowing and sanding our roads.  With this schedule most roads are cleared in time for the morning commute. 

What happens during non-routine snowfall events?

A heavy storm that develops during the night, before daytime roads hours begin at 7:00 am can cause significant accumulations before the roads crews can begin their routes.  Heavy snowfall, drifting, poor visibility and freezing rain conditions can also impair road clearing operations and cause travel delays.   The condition of Highway 17 also impacts the ability of our contractor to complete operations.  Staff continually monitors long term weather reports and current weather conditions to ensure public road safety.  The Township recognizes that these situations are frustrating to residents and will do everything possible to clear the roads as quickly and safely as possible.   Please note that the Township cannot respond to special requests to clear a particular road at any time.  The contractor must follow their assigned routes to ensure timely snow removal for the entire Township.

Why do plows push snow into driveways?  / Why can’t the operator lift the blade in front of my house?

Snow must be pushed to the side of the road to clear the road for traffic.  The Township understands that this unavoidable situation can be frustrating as the corresponding snow ends up in driveways.  Sometimes it is necessary to make several passes with the snowplow during a storm.  At other times it will be necessary to push back the banks to allow room for more snow and to provide room for drainage during the thaw.  Homes that are located near corners or in cul-de-sacs may get more snow in the driveways than homes located on a straight section of road.  This too is unavoidable.   Seasonal residents who visit their cottages during the winter months should expect their driveway’s to be impassable unless the driveways have been regularly maintained.   Snow that has accumulated over the winter will be hard-packed and icy.  Lifting the blade of the snowplow in front of a home to reduce the amount of snow going into the driveway is not allowed.  The snowplow is put into operation to clear the snow off the road and in order for this to happen the blade must stay in contact with the road surface at all times.

 Why can’t the Township sand the sides of the road where I walk?

Roads are maintained for drivers, not walkers.  Sanders are designed with the applicator in the centre of the truck to apply sand to the centre of the road.  The Township understands the desire for fresh air and exercise but during the winter months it may not always be safe to walk on the side of the road.  Icy conditions, poor visibility and snow clearing operations may create dangerous conditions for people and vehicles to share the roadway.  At these times, residents are encouraged to stay off the roads and find an alternate source of exercise.

What do I do if a Township plow damages my property?

First, determine if the damage was caused by the plow or the snow load.  The Township has no control over snow load and does not reimburse homeowners for that type of damage.  This may include trees, shrubs or fences being damaged by the sheer weight and volume of the snow.  Sometimes a plow will damage property by actually hitting an object or by digging into the ground causing damage to vegetation and lawn. 

If your property is damaged by the plow, please call the municipal office at:  613-586-2526.  The Township will repair damage to lawns as soon as spring thaw allows.   Garbage and recycle bins are also vulnerable to plow damage.  To avoid damage, keep your garbage and recycle items in your driveway – not on the roadway.  Do not place items on top of the snow bank.  The Township does not reimburse residents for damage to garbage or recycle bins.

The Township is not responsible for damages that occur on Township property.  The Township owned area between the road surface and the property line must be kept clear of private items such as fences, posts, ornaments, or certain plantings.  The Township does not reimburse property owners for damages to these items.

Hazardous wastes usually have one or more of the following characteristics; they are:

    • Corrosive: they eat or wear away at many materials
    • Flammable: they easily ignite
    • Reactive: they can cause an explosion or produce deadly vapours
    • Toxic: they are poisonous to humans and animals

    Household Hazardous Waste

    North Americans generate over 1.76 million tons (over 3.5 billion pounds) of hazardous household waste (HHW) each year.  Although HHW makes up a very small percentage of the waste stream, it causes a large part of the environmental damage that occurs in waste handling and disposal.

    HHW’s are sometimes disposed of improperly by individuals pouring wastes down the drain, on the ground, into storm sewers, or putting them out with the trash.  The best strategy for us is to avoid hazardous materials if possible. If you can’t avoid using some hazardous products, safe disposal is very important – these materials should NEVER be put in the garbage or down the drain.

    Bring hazardous waste from your home to the Household Hazardous Waste Collection Day.

    • Do I really need to use this?
      • The "new, improved, miracle formula!" may be more hype than help. Sometimes, the old- fashioned methods are simpler and safer. Instead of using hazardous chemicals, you could practice organic gardening techniques (do some research on companion planting, natural pest prevention and composting or use alternative cleaning products).
    • How much do I really need?  Try to buy just enough to finish the job. If you must buy a large quantity, share what's left with a friend or a community group.
    • How will I dispose of this when I am finished?
    • Is using the product worth all the hassle involved in getting rid of it?
    • Find out where the hazardous waste disposal facility is in your community and watch for special collection days. In the meantime store your collection of hazardous wastes out of the reach of children and pets.
    • Hazardous household wastes don't have to be a long-term disposal problem. The next time you have to buy a potentially hazardous product, look for the type that has been recycled. Re-refined motor oil is a good example.

    YOU CAN'T TREAT HAZARDOUS WASTES THE SAME WAY YOU TREAT OTHER GARBAGE.

    • Buried wastes can filter down through the soil and contaminate groundwater.
    • Wastes can clog storm sewers and over-burden septic systems.
    • Plumbing systems can be damaged by corrosive chemicals.
    • Burning hazardous wastes may simply distribute them over a larger area.
    • Pouring hazardous liquids on the ground can poison soil, plants and water.

    Products labelled as corrosive, flammable, reactive or toxic should be disposed of only at a hazardous waste facility. Even if they don't have warning labels, it's safe to assume that products like paint, motor oil and old propane tanks are potentially hazardous too.

    Most of these wastes are produced by industry. Hazardous wastes are an unfortunate by-product of the manufacture of metals and plastics, computer equipment, dyes and paints, among other commodities.

    Government regulations control the disposal of industrial hazardous wastes, but you can do your part to protect the environment by taking special care when you buy, use or dispose of potentially hazardous substances.

    • Prune tree branches to a height of 1 or 2 metres
    • Store fire wood well away from the house
    • Remove trees within 10 metres of house
    • Thin trees (crowns don't touch) at least 30 metres from house
    • Ensure branches are clear of power lines (bury service if possible)
    • Remove brush, mow and water lawn
    • Ensure your 911 sign (civic address) is clearly visible for quick identification
    • Provide an additional emergency exit (if appropriate)
    • Provide a pond or cistern with emergency water supply
    • Utilize only a FireSmart ash pit or burning barrel
    • Ensure driveway is clear of trees to a distance of at least 3 or 4 metres
    • Ensure chimney is installed to code complete with spark arrestor screens
    • All soffit vents and gutters should be screened
    • Porches and balconies should be screened, crawl spaces encloses
    • Position propane tank with valve pointing away from house
    • Build with fire resistant exterior roof and walls
    • Install protective drapes and or shutters on windows to protect interior from radiant heat

    Don't Be The Cause of a Wildfire

    • Chimneys - Chimneys should be constructed to meet current Ontario Building Code requirements and should be screened in with appropriate approved spark arrestors;
    • Burn barrels and Ash Pits - For safe disposal of woody debris you should consider chipping and composting or bringing it to a landfill site.  If you must burn, ensure that the burn barrel is at least 5 metres from any forest or woodlands, 2 metres from buildings or other combustible sources and that a 2 metre area around the barrel is cleared to mineral soil.  Burn barrels should have proper ventilation, screens and should never be left unattended.
    • Power Lines and Propane Tanks - Vegetation should be cleared well back from power lines, propane tanks and other fuel supplies.
    • Shovels and rakes - Every home should have shovels, rakes, axes, garden hoses, sprinklers and roof ladders to assist in suppressing wildfires.(compliments of "The Homeowners FireSmart Manual" Province of Ontario Publication)

    The Risks

    If you live in or near a forested area, you have a lot to lose if a forest fire starts near your cottage or home.  Each year in Ontario, dozens of rural residents and cottagers damage forest lands and lose valuable buildings to fires that could have been prevented.  Nearly one third of these fires are caused by careless burning of household debris - over 200 fires per year.  Sometimes burning grass or brush is a necessary alternative to composting or chipping.  Just make sure you know the rules for outdoor fires and follow safe practices when you burn.

    Among forest fires caused by people, an average of over 200 fires each year are caused by rural residents.

    WHEREAS the fee schedule prepared in 2007 omitted certain classes of building permits;

    AND WHEREAS current practice has resulted in fees that seem too high for simple renovations or repairs in some instances and not adequate to cover the time to perform inspections in others;

    THEREFORE BE IT RESOLVED THAT Schedule A to By-Law # 2007-06, being the Building By-law, be amended to reflect the following:

    THAT the rates for commercial building, renovations, alterations etc. be increased from .20/square foot to .30/square foot;

    THAT the Septic system fees be separated to show Class 2 and 3 system permits being reduced from $300 to $150 with Class 4 permits remaining at $300;

    THAT a new category for Class 1 be set as a no fee permit, simply to advise the CBO for approval of location;

    THAT a new category called Re-roofing be set at $30;

    AND THAT a new category called Minor alterations, repairs, and renovations is set at $15;

    BE IT FURTHER RESOLVED THAT these fees be effective immediately upon passing of this resolution.
